1.Subject-matter and acceptance of the Terms of Use 

Your access and the use of our website are subject to Romanian law.

By placing an order, an individual contract is concluded, which is subject to the rules established and published by GLS in the Terms and Conditions regarding the provision of postal services as well as in the other provisions which establish the terms of use of the ParcelLocker. Please read them carefully. If you do not accept them, please do not use out website. If you continue to use the website, we will consider that you accepted all the published and that you agree to respect them in the version that is published on the website at the moment of your visit.

We reserve the right to modify the Terms and Conditions regarding the provision of parcel services, as well as the other terms of use, by posting the changes on the website, with no prior notice. We kindly ask you to re-read them regularly. 

 

2.Terms and conditions regarding the provision of postal services 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    with its registered office in Sibiu, Dorobantilor street nr. 106, hall B, offers postal services in the following conditions:

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L undertakes not to refuse to collect the shipments, in the event where the Shipper complies with the Terms and Conditions regarding the provision of postal services, that are subject to the public offer lauched by GLS GENERAL LOGISTICS SYSTEMS ROMANIA, which targets both the business sector and the natural persons.

These Terms and Conditions regarding the provision of postal services establish the obligations undertaken by GLS General Logistics Systems Romania and all the conditions that are required to be fulfilled by the beneficiary (Shipper) so that GLS General Logistics Systems Romania could carry out the delivery of the postal shipment properly on the basis of quality criteria.

These Terms and Conditions shall be considered valid with regard to the activities of GLS General Logistics Systems Romania in the postal field, firstly for the performance of providing postal services with a scope of business that includes domestic and international postal shipments,  for the collection of the postal shipments, for their loading and unloading, their handling and transshipment, for interim storage due to the inability to deliver them. 

 

 

Meaning of terms

 

The Shipper of the postal shipments – the contractual partner of GLS, natural or legal persons.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L;

Consignee  - the person who the postal shipment is addressed to;

IOD – electronic or verbal information regarding the status of the postal shipment;

Rollkarte – transport sheet of GLS, issued according to the number of the postal shipment, on which the Consignee acknowledges the receipt of each postal shipment;

POD – the proof of delivery of the postal shipment /extract of the signed transport sheet, as a copy.

 

 

Conditions of acceptance of the postal shipments 

 

The Shipper has to protect in an appropriate manner the goods that are subject to the postal shipment so that they are protected against damage, destruction and they cannot cause any damage to people, environment, used systems or to the other postal shipments throughout the duration of the service. The packaging used by the Shipper is considered adequate in the event where the wrapping protects the postal shipment against  pressure, shock, tautness, etc. from its deposit ot the access point /collection of the postal shipment until its delivery to the Consignee in normal collection, sorting,transport and delivery conditions.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    accepts the postal shipments presented by the Shipper, packed accordingly, with an opaque outer wrapper that does not allow the contents to be seen, and that present the complete data for the identification of the Consignee (surname and first name, the name in case of legal persons, respectively the complete delivery address, with zip code, excepting the postal shipment the are sent with the cash service, where also the data for the identification of the Shipper have to be entered).

The liability for the wrapping of the postal shipments, as well as for writing the data on the postal shipments is held by the Shipper.

The postal shipments that contain fragile goods will be packed accordingly by the Shipper, using as filling parings, anti-impact polystyrene, or other types of material that mitigate the mechanical shock and will have the “Fragile” inscription.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    undertakes to recognize and to respect the inscriptions/labels applied by the Shipper and to pay particular attention to the handling and to the storage of the given parcel shipments.

  • Only completely sealed postal shipments can be accepted,
  • Postal shipments which have long or sharp objects coming out of them are not accepted for transport,
  • The packaging in the form of boxes must be used at maximum – the size and proper quality of the wrapping material and the filling of the empty spaces inside having the role to protect the goods,
  • Fragile goods must be wrapped in polystyrene or other padding and filling materials; the “Fragile” inscription warns, but does not protect them,
  • IT items which are to be repaired shall be handed over in their complete, original wrapping with the corresponding completion of filling materials,
  • Bottles put in the postal shipment must be protected from each other, as well as below and above with protective layers of padding of filling materials,
  • Specially shaped merchandise which is difficult to wrap must be also protected with filling and additional packaging,
  • The packaging in the form of cardboard boxes must be sealed on each side with adhesive tape with the company’s logo, if such possibility is available,
  • The company cannot pick up boxes that are already tied with  tape (as the wrapping may disintegrate and only the postal shipment identified with a label reaches its destination),
  • The envelope which contains the address, the label, the postal shipment sheet and the adhesive labels which identify the additional services must be glued to the largest surface of the postal shipment, near the GLS label with the barcode.
  • If several postal shipments are consigned to the same address, the stickers which identify the additional services must be glued separately on each postal shipment,
  • For the cash service, the amount which has to be collected must be indicated on the cash collection list or with the help of the data sent electronically and on the postal shipment, by using a GLS systematized sticker (in case of several postal shipments, the cash collection sticker must be glued on each postal shipment and the amount to be collected shall be indicated in accordance with the value of each postal shipments). In case of wrong or incomplete information, GLS shall make all efforts to clarify the situation.
  • If the Shipper is a natural person, the cash on delivery amount has to be specified on the wrapping of the postal shipment or on its label. The bank account of the Shipper also has to be specified, if order to be able to transfer the collected cash on delivery amount.

Goods having a hazardous content are not accepted, not even if they are labelled accordingly.

 

 

The following postal shipments are excluded from collection:

 

- shipments that are inadequately packed,

- postal shipments that are tied to one another with adhesive tape,

- alterable products, products which can be contagious, products which can cause nausea,

- human remains,

- living animals and plants,

- products packed in bulk, in bags, in sacks,

- goods with a special value, such as money, precious metals, documents with a financial value, winning tickets and similar tickets, pearls, jewellery, precious stones, etc,

- pieces of art, items of personal value,

- temperature sensitive items,

- ammunition, fire weapons, explosives and similar products,

- postal shipments addressed to the Consignee’s P.O. box,

- international postal shipments that contain royalty products, alcoholic drinks, tobacco,

- products which are considered hazardous as per ADR (Ordinance on the transport of hazardous goods on public roads),

- postal shipments (goods) whose shipping is prohibited according to all applicable sanctions, for example, because of their content, consignee or country of destination where the goods are to be shipped;  Sanctions include all laws, regulations and orders that impose sanctions (including trade restrictions and economic sanctions) to certain countries, natural or legal persons, including without limitation, the sanctions imposed by the United Nations, the European Union and the Member States of the European Union.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L does not accept postal shipments whose packaging present inscriptions that are contrary to public policy or morality, as well as postal shipments that contain goods that are contrary to public policy or morality, if they are collected unpacked.  Goods whose transport is forbidden by law are also excluded from being sent as postal shipments, even only on a segment of the route (for example, but not limited to: explosives and toxic, flammable materials, psychotropic substances, drugs, weapons of parts thereof, munition, etc).

The Shipper is obliged not to introduce in the postal network postal shipments which are forbidden by law.

 

 

Weight and Dimension Limits of the Postal Shipments

 

Parcel shipments may be dispatched in a weight of up to 50 kg.

The girth (girth =  2x height + 2x width+1x length) may not exceed 3 meters, and the maximum permitted length is 2m, maximum height 0,6 m and maximim width 0,8 m. The postal shipments of up to 2 kg and a maximum length of 40 cm are called Business SmallParcel, and the rest of up to 50 kg and a maximum length of 2 m are called Business Parcel.

Each postal shipment will have to be provided with a label with a corresponding barcode.

GLS weights each postal shipment – according to the contract concluded with the legal persons – automatically on a scale in the depot or in the sorting unit and registers the weight data assigned to each postal shipment.  The weight data constitutes automatically the basic data for invoicing.  

In the case of natural persons,  the size of the postal shipment has to be established (S, M, L XL), and the costs are established according to the size of the postal shipment. 

 

 

Storage time for the postal shipments

 

In the case of the postal shipments that could neither be handed over to the Consignee, nor returned to the Shipper, S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L shall store these postal shipments for 9 months starting from the date of their collection. After this deadline expires, the postal shipments that were unclaimed are no longer the property of the shipper, they become the property S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   .

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  has to hand over to the Shipper the registered postal shipment that could not be delivered to the Consignee in one of the following situations:

-the Consignee’s address does not exist or at the address there is no building where the postal shipment could be delivered,

-the Consignee or the person authorised to receive the postal shipment was not found at the address indicated, and the storage deadline for the postal shipment at the contact point has expired,

-the Consignee or the person authorised to receive the postal shipment refused its delivery.

 

 

Confidentiality

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  assures, through appropriate organizational and technical measures, the confidentiality of the postal shipments that enter the GLS postal network.  

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    assures the secrecy of the postal shipments – the withholding, the opening, or the disclosure of the content of the postal shipments in allowed only in the conditions and according to the procedures  stipulated by law.

In the case of the international postal shipments the legal provisions in force in the field of customs, as well as the legislation of the other states transitted by the postal shipment, and respectively, on the teritory of which the postal shipments is collected/ delivered, shall be respected, aditionally, by both parties. 

 

 

Obligations of GLS General Logistics Systems Romania SRL

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  delivers postal shipments in the best safety conditions, permanently making sure that the postal shipment reaches the consignee.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L also protects the content of the postal shipments through the following actions:

a) is not allowed to open the postal shipment,

b) is not allowed to disclose to others – except for the Shipper, the Consignee  and respectively of the competent bodies. – the data found out during the provision of the services.

c) cannot handover the postal shipment – to find out its contents – to anybody else except for the Shipper, the Consignee (respectively to other authorised individual) and the competent bodies,

d) cannot disclose any information about the provision of services to others – except for the Shipper, the Consignee (respectively to other authorised individual) and the competent bodies.

 

 

Shipper’s obligations

 

The Shipper must wrap each parcel as per requirements of handling of postal shipments and provide such postal shipments with fully filled-in GLS systematized labels (provided by the supplier, free of charge) and respectively provide them with the proper documents, according to the situation.

For the cash service, the amount that has to be collected from the Consignees that are natural persons, shall be written on the packing of the postal shipment or on the label

Attached to the postal shipment that is subject to this service.

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  is not liable for for any fill-in mistakes.

The staff of S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  can refuse the collection of  the postal shipments that are clearly inappropriate to the established conditions of acceptance.

The Shipper shall use the following proofs to identify the postal shipments:

  • A copy of the label of the postal shipment,
  • A mini-label of the number of the postal shipment (sticker, it detaches from the postal shipment ticket in 2 originals).
  • In the case of a postal shipment label drawn up according to the Shipper’s own system, an electronic data file commonly agreen upon between GLS and legal persons, under the existing contractual agreement.

The Shipper that is a legal person is obliged to transfer until the due date in the account of S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    the fees for the service that was rendered.

If not, S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    is entitled to perceive delay penalties of 0.1% per day, the total amount of such penalties can exceed the invoiced amount.  

In the case of natural persons, the payment will be done before the provision of the service by bank transfer.

 

 

The services offered by GLS are the following:

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L provides the Express service, a postal service that implies cumulatively:

  • The delivery of the postal shipment at the Consignee’s address, directly to the Consignee or to the person that is  authorized to receive the postal shipment;
  • Liability for the postal shipments that wered delivered with a delay;
  • Fast delivery of the postal shipment;
  • S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    shall mark all the postal shipments that are subject to this postal service with the inscription “Express”;

·         If the client/Shipper chose the Express service, the postal shipment shall be identified individually and based on this the consignment shall be monitored within the technological process (fast domestic postal shipment delivery service / express parcel);

  • The issue by the provider to the Shipper of a document that confirms the date and time of delivery of the postal shipment;

· GLS does not provide the Express service within the same city;

· Should any delays occur because of the service provider in the case of express postal shipments delivered through the delivery service for postal shipments – with guaranteed delivery by the deadline – the double amount of the additional service fee shall be paid as compensation ( the difference compared to a standard postal service);

· For the Express service, the collection of the postal shipments is carried out from Monday to Thursday, from 10 to 18.

· The delivery times that S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    guarantees for the Express service are: 24 hours between county seats and within one county, 36 hours in other location, this postal service thus being unavailable within the same location (collection and delivery in the same city);

· In the case of the international postal shipments, the period when the postal shipment is on Romanian territory cannot exceed the limits stipulated by the present conditions, related to national territory;

· In the case of the international postal shipments, the period when the postal shipment is on Romanian territory cannot exceed the time in which the same postal shipments would be found outside Romanian territory in the case where it would be subject to the standard postal service offered by providers of universal services;

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L offers the Pick&Ship service (Collection and Shipping), repectively, in two-ways Pick &Return(Collection and Return), that facilitates the movement of commercial products that are subject to the postal shipments towards consumption, transport of the products that need repairing, warranties, etc.

The pick-up orders of the postal shipments shall be carried out one day before their collection, until 18 o’clock.

· The documents regarding the returned postal shipments are not verified at pick-up; these documents are not accepted separately from the postal shipment, these must be attached to the postal shipment or introduced in the postal shipment.  

· If the Shipper that is a legal person wants to send more postal shipments than the ones noted on the order, the additional postal shipments cannot be collected because the GLS employees has the exact number of labels for the postal shipments that was written on the order;

· The feature that is subject to the postal service refers to the delivery time. The postal shipments will be delivered at the consignee’s address on the next working day following pick-up, during working hours.  

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    provides the cash on delivery/COD service, postal service that implies the payment by the Consignee to the Shipper, through the postal network, of the value of the goods that are subject to the registered postal shipment.  

· The collection of these domestic postal shipments is carried out only in the situation where the Shipper indicated correctly and fully their own identification data.   

· The allowed currency for the collection of the Cash on delivery amount and for the transfer of the cash on delivery amount from the consignees is RON.

· The delivery time of the domestic postal shipments that are subject to this service is 1 (one) working day, and the return time of the cash on delivery amount for the postal shipments to the Shipper (the amounts collected from the Consignee) is of a maximum 5 working days from delivery by bank transfer.  

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    provides a Declared Value Insurance service for postal shipment with a maximum weight of 2 kg or postal parcels with a maximum weight of 10 kg, respectively postal parcels with a weight limit between 10-20 kg shipped from a teritory outside of Romania to an address found in Romania, as well as a Declared Value Insurance service that applies to any type of postal shipment–DeclaredValueInsurance (insurance at a declared value). In the case of the Declared Value Insurance shipments, the maximum accepted value of the declared value is 7000 RON. In the event where the Shipper declared a lower value than the real value, the compensation is carried out at the level of the declared value.  

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    provides the PreAdvice Service . In the morning hours, GLS sends a text message informing the Consignee of the estimated time of delivery. The text message contains the identification number of the postal shipment, the estimated time of delivery specified as a three-hour window and the telephone number of the GLS driver.

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    offers the possibility of associating to any type of service the DocumentReturn Service(returning of documents). This document management is a solution for situations where special shipping documents need to be collected from the Consignee or certified by the Consignee and then returned to the Shipper, in a maximum of 5 working days after the delivery of the postal shipment.

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    provides postal services for international postal shipments in the countries from the European Union, as well as Turkey, Norway and Switzerland, in cooperation with the GLS system, that targets:

- Postal shipments sent by the members of the GLS system with the destination of Romania from the locations mentioned above, as well as the customs clearance and the delivery of the postal shipments.

- Collection, handling, transport and delivery of the postal shipments carried out by external contractual partners of  GLS, in a manner that allows the parcel shipment to remain permanently under GLS supervision from its collection until its delivery, and the information regarding the postal shipment and the POD that confirms the delivery of the postal shipment to the Consignee can be searched at any time (in 6 months statute of limitations from the date of the collection of the postal shipment). The delivery times for these postal shipments are different according to the destination country, between 2 and 8 working days from collection (when no customs clearance is needed). The clearance time can vary based on local regulations, and the clearance costs can be invoiced either to the Shipper or to the Consignee. In the event where the Consignee that receives an international postal shipment does not respect his obligations regarding the payment of the clearance costs, these costs shall be invoiced to the Shipper.In the event where the Consignee’s address is modified, GLS assumes the responsibility to correct the address and delivery to the corrected address. The service includes a second delivery attempt, if the first delivery attempt failed.

For legal persons, additional services can be selected , against payment,  according to the agreement in force (customs clearance, cash on delivery collection, the amount thus collected being returned by bank transfer, pick and ship, pick and return, document return, etc.). For these services a separate convention shall be concluded.  The postal services may also present additional features.

For natural persons, the Cash on Delivery service that refers to international postal shipments is not available.

 

 

Delivery of postal shipments

 

For the postal services that are provided, excepting the Express service and the services already mentioned, S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   attempts the first delivery of the postal shipment to the Consignee in the following working day after the date the postal shipment was collected. If the first delivery attempt failed, the second delivery attempt is integrated in the basic service. When the delivery failed due to a wrong address or due to another cause, which can be corrected by the Shipper, GLS will ask the Shipper to correct the error. If the second delivery attempt failed or if the correction procedure failed, the postal shipment will be returned to the Shipper.

 

The delivery of the postal shipments is done at the address indicated by the Shipper, either directly to the Consignee, or to the person authorised to receive the postal shipment. If it is initially impossible to deliver the postal shipments to the Consignee,  

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   will notify the Consignee through a notice that informs them that the postal shipment arrived and will attempt a second delivery of the postal shipment within 5 working days (in the period of the notice), if the Consignee of the postal shipment will not contact during this period the GLS representative indicated on the notice.

Thus, if the postal shipment cannot be delivered, GLS will store it for 5 working days after the first failed delivery attempt  (excepting the situation when the Consignee is on holiday, in this case the postal shipment is stored for 10 working days). After this period expires, the postal shipment is returned – without any notice - to the Shipper.

 

GLS does not attempt a second delivery of the postal shipment and the postal shipment will be returned to the Shipper if the delivery was refused or based on the indications given by the Shipper during the correction procedure, after the fixed notice time expired.

The guaranteed delivery interval for domestic postal shipments is of 5 working days.

 

The delivery interval for the international postal shipments is within 2 to 8 working days, to which additional time can be added due to customs procedures: Hungary (2), Czech Republic (3), Slovenia (3-4), Slovakia (2), Bulgaria (2), Serbia (3-4), Poland (3), Germany (4), Switzerland (4), Belgium (4), Netherlands (4), Luxembourg (4), Liechtenstein (4), Austria (3), Italy (4-5), Croatia (3), Denmark (5), France (6), United Kingdom (6), Ireland (6-7), San Marino (4-5), Vatican (4-5), Monaco (5), Portugal (6-7), Spain (6-7), Canary Islands (Spain 6-7), Greece (5-7), Andorra (6-8), Gibraltar (6-8), Sweden (5-6), Finland (7), Norway (6-7), Malta (7-8), Cyprus(7-8), Estonia (7-8), Lithuania (7-8), Latvia (7-8), Turkey (7-8).

 

GLS shall be liable for the delayed delivery of the postal shipments by paying penalties of 0,1% per day of delay from the cost of the service in the case of postal shipments, other than the Express Service.

  • For the postal shipments with the Pick & Ship service that were handed over to GLS until the hour that was agreed upon in special contracts concluded with legal persons, the delivery will be attempted starting with the following working day. („24 hours” does not mean the performance time, it exclusively indicates the following working day).
  • Postal shipments shall be delivered against the signature of the Consignee or of other people authorised to receive the postal shipments, this including the people who have a power of attorney.
  • The delivery shall be confirmed by the Consignee by signing on the form issued by GLS.
  • Besides the signature, GLS will also request the name of the person who received the postal shipment, which will be introduced together with the saved data in the manual scanner, thus the name of the receiver can be searched for in the existing electronic data about the postal shipment.
  • For the postal shipments with the cash service, the delivery shall be done after payment of the cash collection fee and after signing of the acknowledgement of receipt. The Consignee cannot check the contents of the postal shipment beforehand.
  • If the Consignee is not present, the Shipper can mandate S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   to deliver the postal shipment to a neighbour or to another appropriate person or eventually leave it in the Consignee’s mailbox. Here are included all the people that are present at the Consignee’s premises and the ones that have a power of attorney For such powers of attorney, the proof of delivery (IOD, POD) will be drafted in a modified form.
  • For the proof of delivery service, the return time to the Shipper of the written confirmed proof regarding the delivery of the postal shipment that is subject to this service is 2 - 8 working days and the proof will be sent to the Shipper scanned, via e-mail.

For natural persons, GLS offers the posibility to use the GLS ParcelLocker. Thus, after the delivery of the postal shipment at the address indicated by the Shipper failed,  the Consignee can choose a new delivery at a ParcelLocker. In such a situation, the Consignee will be notified and will receive a unique code, by SMS and/or e-mail, that he will introduce at the ParcelLocker and that allows him to open the box that contains his postal shipment.  The code will be transmitted to the Consignee when the postal shipment is placed by a GLS representative (driver) in the ParcelLocker. GLS will store the postal shipment in the ParcelLocker for 5 working days from this date.

 

The Shipper also has the possibility to introduce a postal shipment into the GLS postal network with the use of the ParcelLocker. In such a situation, where the Shipper chooses to place a postal shipment/parcel into a ParcelLocker,  he shall introduce on the GLS website the details regarding the delivery, shipper, consignee, shall pay the fee for the chosen service, then he will receive a file in a .pdf format, containing the label that he has to print and place on the postal shipment. When he arrives at the ParcelLocker, he will have to scan the barcode from the parcel shipment label, and at the time, a box shall open, when he can place the postal shipment.  At the end of the day, a GLS representative will collect the postal shipments that were placed into the ParcelLocker and will send them to the delivery depot, which will deliver them in the legal term previously agreed upon.

 

 

Information regarding the postal shipments

 

The customer or his representative may ask for information about the parcel from the Customer service department based on the parcel number; then he can also ask information about the delivery of the parcel (IOD), respectively he may ask for a proof of delivery (POD). Information about the parcel (IOD) are provided immediately in the case of parcels consigned within the last 3 months and the proof of delivery (POD) is sent within 4 hours in the case of parcels consigned within the last 3 months.

After this period the information about the parcel may be requested for another year from the date of delivery of the parcel but the term for provision of such information shall be extended with three working days.

The POD is available two working days after delivery.

GLS provides the customer by telephone or through the online track and trace system with information about the delivered parcels (IOD) starting with the morning of the second working day after the collection of parcels. The written proof of delivery (POD) can be asked by the Customer free of charge for 5% of the average number of parcels handed over in one day. GLS has the right to ask for fees and the Customer has the obligation to pay a 10 lei fee per document for the delivery of official documents if requests exceed this percentage. The signed transport sheet (Rollkarte POD) or the acknowledgement of receipt replacing it, recognised electronically (in scanner) and signed is considered a proper delivery document.

For the fixed locations,  that are unserved by staff (ParcelLocker) only the delivery information exists, that shall be provided at the Shipper’s request.

 

 

Contractual liability before the Shipper

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    is liable, in the event of loss, theft of total damage, for the domestic postal shipments, as follows:

- with the entire declared value, for a postal shipment that is subject to a shipment service with declared value.  

- with the entire declared value, for a postal shipment that is subject to a shipment service with cash on delivery, until the moment the postal shipment is delivered to the Consignee and respectively, after its delivery to the Consignee, when the postal service provider omitted to collect the cash on delivery from the Consignee.

- with an amount representing 10 times the fee for the service, for the postal shipments that are not subject of a shipment service with declared value.  

 

In case of loss or total damage or deterioration,  S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   shall be liable as follows:

- with the share corresponding to the weight that is missing from the declared value, for the postal shipments that were handed over sealed, that are subject to shipment service with declared value.;

- with an amount representing 10 times the fee for the service, for the postal shipments that are not subject of a shipment service with declared value.  

 

The legal penalty interest accrued from the moment of the introduction of the prior complaint or the request for summons is added to the set amounts, regardless which of these moments occurs first.

 

The complete loss of the content is equivalent to the loss of the postal shipment.   

In the event where the shipper declared a lower value than the real value, the compensation is carried out at the level of the declared value.  

Excepting the compensation mentioned above, the fees collected at the takeover of the postal shipment shall also be returned.

 

In the event where the additional postal services that are requested by the Shipper by special indications are not carried out, only the service fees paid in addition to the fee for the standard postal service are to be returned.

In the event where the proof of delivery regarding the delivery of the registered postal shipment, confirmed in written by the Consignee is lost,  the postal service provider is obliged to supply a duplicate of the proof of delivery to the Shipper.  

GLS General Logistics Systems Romania SRL is liable before the Shipper for the provision of the service in the conditions established by law and in the contract concluded with the Shipper.  

 

Regarding the shipments collected for delivery, GLS assumes its responsibility according to the general regulations established by law, if by agreement of the parties no conditions of worsening liability are set.

 

The Shipper, in the measure he considers necessary, can take additional measures concerning the prevention of damage of of loss of the shipment by by taking an insurance policy at an insurance company or by paying additional fees that will be negociated and set out in a contract concluded in this regard.  

GLS compensates its Shippers every time for damages up to the extent described in the present Terms and Conditions, that are consistent with the contract concluded between the parties,  taking into account the exclusions and the clauses hereunder.

GLS does not assume responsibility for indirect loss and loss of profit.

 

The following types of goods are excluded from the coverage of damages, taking into account that they are not accepted in the postal network of GLS:

  1. Cash, coins, banknotes, stamps, items of value;
  2. Bonds, official documents, winning lottery tickets, when it comes to the value they represent;
  3. Gold, silver (processed or not) and other precious metals processed and not processed whose value reaches at least that of silver;
  4. Goods improperly wrapped considering their nature or the circumstances of parcel transporting (goods placed in sacks, bags, in bulk);
  5. Pearls, precious stones, jewellery;
  6. Pieces of art, objects of special personal value;
  7. Inflammable materials, explosives, toxic items or items which pollute the environment;
  8. Weapons and ammunition;
  9. Living animals and plants;
  10. Perishable goods, parcels which need controlled temperature;
  11. Engines;
  12. Human remains;
  13. Products which are considered hazardous as per ADR (Ordinance on the transport of hazardous merchandise on public roads).

GLS is exempted from liability in these situation :

- the damage occured due to the Shipper or Consignee;

- the postal shipment was received with no objections by the Consignee, excepting the claims regarding the loss, theft, deterioration or complete damage of the content of the postal shipment;

- the user has no mailbox installed, that allows the postal shipment to be handed over of this does not assure the security of the postal shipments or, does not have a service for the receival of postal shipments;

- GLS is not liable for the loss, destruction, deterioration,failed or wrong delivery of a postal shipment in the event where these are generated  by unforeseeable circumstances or force majeure, as they are defined by the legislation; in such situations, the fees that were paid shall be returned, exception the insurance fee.

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    is not liable for the any alterations of the postal shipments due to electromagnetic means or causes  (for example, demagnetization, x-ray scanning during the security/customs procedures, etc). 

GLS is liable for the international postal shipments according to the provisions of the international agreements that Romania is part of. In the event where there are no international agreements, the provisions of the legislation in this field shall be applied. 

 

 

Complaints management

 

The Shipper or Consignee that is dissatisfied with the service that was carried out can submit a claim within 6 months from the date the postal shipment was collected.  

 

The claim of the user that considers himself prejudiced /dissatisfied shall be submitted in writing and forwarded to the provider by one of the following means: in person, at the headquarters of S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   , by postal service with acknowledgement of receipt to the address Sibiu, Dorobantilor street, number 106, hall B, Sibiu county, by fax at number 0269501950.

 

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L   shall register in the Claims registry and shall confirm to the complainant the receipt of the claim through the same method chosen by the user to submit the claim or requested by the complainant, namely: by handing out a registration number, when the claim was submitted in person, by signing the acknowledgement of receipt when the claim is submitted by means of a postal service with acknowledgement of receipt and by communicating the registration number by fax.

 

In order to facilitate the settlement of the claim, the complainant user shall describe the event (facts, paperwork and causes) related to the claim, to formulate their demands, the payment method chosen in the event of compensation, to attach all the relevant documents to the submitted claim so that GLS is able to carry out a correct and complete analysis (such as, a copy of the document that confirms the payment of the postal service, a copy of the commercial invoice/receipt, pictures, the wrapping/deteriorated shipment, etc.) and to provide any other information that could be useful to resolve the claim (for example, the reference number for the postal shipment (label), consignee, etc.).

 

The representatives of S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    shall analyze the submitted claim by taking into account the proofs submitted by the complainant, but also the relevant information/proofs provided by their own employees of third parties, and when needed, an expertise can be requested.  

The claim shall be resolved by S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L within 3 months from the date when it was submitted.  

 

In the claim settlement, GLS General Logistic Systems Romania SRL shall also mention the amount that will be granted as a compensation and will request that the legal persons issue an invoice for the compensation to S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L  for the amount communicated by the company (GLS), that will be granted as a compensation, and the natural persons will be requested to indicate the data needed in order to pay the compensation (for example, the bank account and its holder).

S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R. does not assure those values which are already protected by another insurance. Such values can not be subject to the Declared Value Insurance Service.   

 

The provider shall pay the compensation amount, within a maximum of 30 calendar days from the date of the favorable resolution of the claim in regard to natural persons and respectively, within  8 (eight) calendar days in regard to legal persons (nevertheless taking all the measures regarding the payment starting from the day the invoiced issued by the prejudiced legal person arrived).

The payment of the amount of money owed to the user shall be done, for legal persons and for natural persons, by bank transfer.  

A claim for damages document shall be submitted, which can be found on the GLS website and an account shall be indicated, where the amount for the claim for damages shall be transferred.  

 

In the situation where the claim addressed to the postal service provider S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L    was not resolved in a satisfactory manner, or no answer was given within the deadline stipulated in the present Terms and Conditions regarding the provision of postal services, the concerned user  can submit, within a year from the date the postal shipment was collected, a complaint to the regulatory authority accompanied by evidence showing the fulfillment of procedures regarding the prior complaint or a request for summons. The request for summons can be submitted regardless if a complaint having the same object was forwarded or not to the regulatory authority.  

 

The liability in the event where the delivery is carried out by another contractual provider of  GLS Romania  lies with S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L.

 

 

Customer Service Office

 

At its office GLS has a Customer service department which works from 8 a.m. to 6 p.m. on working days and provides information on delivery (IOD) based on parcels numbers, after having received a written request; this department also sends the Customer the proof of delivery (POD) and manages any complaints related to the transport of parcels that entered the postal network of GLS.

The information related to the delivery of parcels (status) may be downloaded as of the second working day after the taking over of the parcel from the web page www.gls-romania.ro based on the parcel number from the Parcels search menu (Track & Trace).

These Terms and Conditions regarding the provision of Postal shipment services offered by GLS Romania are completed accordingly by the provisions OG 13/2013, with subsequent amendments, and by the Decision of the President of the Romanian National Regulatory Authority for Communications and Information Technology, no 2858/2007, as it was amended by the Decision of the President of ANCOM no 891/2009 and by the Decision of the President of ANCOM no 513/2013.

The present document represents the individual contract concluded between the Shipper and  S.C. GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L, at the moment of acceptance of the postal shipment into the postal network, with no need to draw up a certificate; the provisions of the present document are completed accordingly by the clauses inserted in the special contract concluded between GLS and the Client/Shipper, if applicable.

 

 

3. INFORMATION NOTE ON THE PROCESSING OF PERSONAL DATA BY MEANS OF VIDEO SURVEILLANCE

S.C.GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L. headquartered in Sibiu, Dorobantilor street, nr.106, hall nr. 3, registered at the Trade Register Sibiu under no. J32/1695/2007, CUI 2161139  processes your personal data, respectively the image by  automatic means, in order to monitor the access of persons and to ensure their safety and that of spaces and of this equipment named ParcelLocker.

According to Law no. 677/2001, you have the right of access, of intervention on data, the right of opposition, the right not to be subject to individual decisions and the right to go to court.

In order to exercise these rights, you can address a written, dated, signed request to the headquarters of S.C.GENERAL LOGISTICS SYSTEMS ROMANIA S.R.L in Sibiu, Dorobantilor Street, number 106, to the person responsible for the protection of personal data.

Personal data can also be provided to the Public Prosecutor’s office, Police, Courts and other relevant government institutions, on the basis and within the legal provisions and as a result of expressly stated requests.

If some of your personal data is incorrect, please inform us as soon as possible. 

 

 

5.Terms and conditions for card payments

Types of cards that are accepted for the payment of transport services.  

The payments on the website of GLS România can be carried out with the following types of payment cards:

  • MasterCard
  • Maestro
  • Visa and Visa Electron

After placing the order and paying it using a payment card, the invoice shall be issued and the label that has to be attached to the parcel will be generated. In order to cancel the transport order, please contact the customer service department via e-mail at the following address: customerservice@gls-romania.ro.

The payment with a debit/credit card on the website GLS România ParcelLocker is a safe method. The website of GLS România has implemented the security systems MasterCard SecureCode and Verified by Visa. Before paying by credit/debit card, please check with your bank if the card can be used for online transactions.  

As part of the acquisition process or of reimbursement procedures and according to the payment method that you selected when you placed the order, you will provide data regarding the bank account, information regarding the debit or the credit card to a third party provider, a provider of payment processing services. This data is used in order to make payments to us or for our reimbursements to you.  In this case, you offer the payment data directly to the third party provider, and not to us, and you will be subject to the privacy policy of this provider of payment processing services. We recommend that you read these terms before selecting the payment method. We do not receive, save or process this data regarding payment, but we may have access to the data through the systems of the provider of payment processing services for the purposes described in this section.
